**Terms of Service for Video Production Plans**
 

These Terms of Service ("Terms," "Agreement") govern the use of the subscription service called video production plans provided by MWM CREATIONS ("we," "us," or "our") to clients ("you" or "your"). By engaging our video production services, you agree to be bound by these Terms. Please read these Terms carefully before using our services.

 

**1. Scope of Services:**

We offer professional annual video production services on a subscription based format, which include but are not limited to creating, editing, and delivering video content according to the agreed-upon specifications and requirements outlined in the project proposal.

Usage of Film Shoots: Unlike edited video minutes, film shoots allocated under your subscription plan are cumulative. Any unused film shoots from one month will roll over to the following months within the same annual subscription period. This allows you flexibility in scheduling and utilizing your film shoots throughout the year without the risk of losing them at the month's end.

Usage of Edited Video Minutes: Each subscription plan includes a specified amount of edited video minutes per month (e.g., the Platinum plan includes up to 60 minutes of edited videos per month). Unused minutes do not roll over to the next month. Each new month resets the available edited video minutes to the amount specified in your plan. Therefore, minutes not used during a given month are forfeited and will not accumulate. (This section does not apply for ENTERPRISE subscribers, please see section #5)

 

**2. Client Responsibilities:**

You agree to provide accurate and complete information regarding your project requirements. You are responsible for obtaining all necessary rights, licenses, and permissions related to any materials you provide for use in the videos.

 

**3. Project Timelines:**

Our standard timeline for delivery of videos is 7 to 9 days after they are fully recorded. These timelines are subject to change due to unforeseen circumstances or delays beyond our control. We will make reasonable efforts to keep you informed of any changes to the timeline.

 

**4. Revisions and Changes:**

We understand that creative projects may require revisions and adjustments. We offer a set 3  revisions for each video, free of charge for 30 days after the delivery. Additional revisions will incur a fee of $250 per revision to be charged on your chosen method of payment.
If after 30 days of the delivery of the video, the client did not request any changes, your delivery will be marked as approved.

The timeline of delivery for revisions is up to 3 business days.

 

**5. UNLIMITED Editing (ENTERPRISE Plan Only):**

Client shaw request unlimited edits on a month under the understanding that we will work on one request at a time. Each edit will be requested, edited, delivered and approved before the team can star working on the next request.

 

**6. Delivery of Final Videos:**

Upon completion of the video productions, we will deliver the final videos to you in the agreed-upon format and method of delivery. We will retain a copy of the final videos for a limited time, but we are not responsible for storing the videos indefinitely.

 

**7. Request for Raw or Unedited Material:**

As part of our video production services, clients have the option to request raw or unedited material from the completed project. We understand that some clients may have specific needs.

To request raw or unedited material, the client must submit a formal written request via email or through our designated customer support channel. The request should include the specific details about the footage.

Please note that the provision of raw or unedited material is subject to an additional cost of $25.00 per minute of footage requested. The total cost will be calculated based on the duration of the raw material provided.

Upon receiving the client's request, we will provide an itemized quote detailing the total cost for the raw material. Payment must be made in full before the raw material is delivered. Once the payment is processed, the raw or unedited material will be provided in a suitable digital format for download or via a secure file-sharing platform.

**8. Film Shoot Days Cancellation and Rescheduling Policy:**

To maintain efficiency and ensure resource availability, we require a minimum of 72 hours' notice for the cancellation or rescheduling of any film shoot. This policy allows us to manage our scheduling and allocate our resources effectively.

Notice Period:

• Clients must provide notice of cancellation or rescheduling at least 72 hours prior to the scheduled shoot day. Notice must be given in writing by email to our designated contact address.

Consequences of Late Notice:

• If a client fails to provide the required 72 hours' notice, the scheduled film shoot will be considered forfeited. This shoot will then be deducted from the client's package, and no refunds or credits will be issued for the missed session.

Exceptions:

• Exceptions to this policy may be considered on a case-by-case basis, particularly in the event of unforeseen and extreme circumstances. Such exceptions are at the sole discretion of MWM CREATIONS management.

 

**9. Intellectual Property:**

You retain all rights to the content you provide for use in the videos. Unless otherwise agreed in writing, we retain the intellectual property rights to the video production, including but not limited to raw footage, project files, and any original creative elements.

 

**10. Confidentiality:**

We will treat all information provided by you as confidential and will not disclose it to any third parties without your consent, except as required by law.

 

**11. Subscription, Payment and Pricing:**

We offer annual subscription plans. Starting from the date of subscription. When you choose and accept one of our plans, you are committing and agreeing to a 12 month payment plan that is automatically renewed for successive 12-month periods unless you cancel your subscription in accordance with Section 10 (Cancellation and Termination). You agree that payment will be processed automatically on a monthly basis using the payment method you provided during the initial subscription. All prices are quoted in the local currency and are exclusive of any applicable taxes or fees.

 

**12. Service Cancellation fee and Termination of subscription:**

You may cancel your Subscription Plan at any time by contacting our customer support or through your user account settings. If you cancel your subscription before the end of the 12-month term, you will be charged a fee equal of 2 months of your current subscription plan and not be entitled to a refund for any unused portion of the subscription. 

 

**13. Automatic Renewal:**

Your subscription plan will automatically renew at the end of each subscription period. Unless you notify us of your decision to cancel the subscription at least 30 days prior to the renewal date, your plan will renew automatically using the current rates published on our website. To cancel, please follow the instructions in the Cancellation and Termination section.

 

 

**14. Limitation of Liability:**

We will make every effort to ensure the quality and accuracy of the video production. However, we are not liable for any direct, indirect, incidental, consequential, or punitive damages arising from the use of our services.

 

**15. Governing Law and Jurisdiction:**

These Terms shall be governed by and construed in accordance with the laws of the state of Florida, United Stares Of America. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in Florida, US.

 

**16. Amendments to the Terms:**

We reserve the right to modify or update these Terms at any time. Any changes will be effective upon posting on our website. It is your responsibility to review these Terms periodically.

 

By using our video production services, you agree to comply with these Terms of Service. If you do not agree with any part of these Terms, please refrain from using our services.
